Right to appeal

Here you will find information on how to appeal a decision from the Migration Board. Special rules apply if you are an EU/EEA-citizen wanting to study in Sweden.
If you are a citizen of a country outside the EU/EEA-countries and want to study at the university, college, upper secondary school, folk high school, exchange student or other forms of studies you have the right to appeal a refused application.

Citizen outside the EU/EEA


If the Swedish Migration Board rejects your application for a residence permit, you may appeal the decision within three weeks of the date you were given the decision. Send your appeal to the Swedish Migration Board.

If the Board upholds its decision to reject your application, your appeal will be forwarded to the Migration Court at one of the three administrative courts, in either Stockholm, Göteborg or Malmö. Which court will hear your appeal depends on which Permit Unit rejected your application.  

How it is done

  • write which decision you want to appeal and how you want it changed
  • write your name, personal number or time of birth, address and phone number
  • sign the letter with your name
  • send the appeal to the unit who made the decision in your case.

Power of attorney


If you have given power of attorney (and thus the right to represent you) to someone in Sweden, that person can write and submit the appeal for you.
 

EU/EEA citizen


A decision regarding registration cannot be appealed. If you do not have right of residence, and as a result you are not registered, you can apply for a residence permit instead.
