Right to appeal

Here you will find information on your possibilities to appeal a rejection from the Swedish Migration Board.

esidence permit


If the Swedish Migration Board rejects your application for a residence permit, you may appeal the decision within three weeks of the date you were given the decision.

How it is done

  • Write which decision you want to appeal and how you want it changed.
  • Write your name, personal number or time of birth, address and phone number.
  • Sign the letter with your name.
  • Send the appeal to the unit who made the decision in your case.
If the Board upholds its decision to reject your application, your appeal will be forwarded to the Migration Court at one of the three administrative courts, in either Stockholm, Göteborg or Malmö. Which court will hear your appeal depends on which Permit Unit rejected your application.
 

Power of attorney


If you have given power of attorney (and thus the right to represent you) to someone in Sweden, that person can write and submit the appeal for you.

If you are a minor


If you are under 18, you cannot appeal a rejection yourself. Your parents or guardians may appeal for you.

Right of residence and residence card


A decision regarding registration cannot be appealed. If you do not have right of residence, and as a result you are not registered, you can apply for a residence permit instead.

A decision regarding residence card cannot be appealed. If you do not have the right of residence card, you can apply for a residence permit instead.
