Legislative change affects who is entitled to LMA
On 1 August 2017 the reception of asylum seekers act (LMA) will change. The change means that some asylum seekers will no longer have right to assistance in accordance with the LMA. For example the assistance includes a daily allowance from the Swedish Migration Agency for asylum seekers who do not have any money of their own and accommodation provided by the Swedish Migration Agency for people who are unable to arrange their own accommodation.
After 1 August 2017, EU citizens seeking asylum in Sweden will no longer be entitled to support in accordance with the LMA, unless there are special grounds.
Decisions in accordance with the Dublin Regulation
Asylum seekers who have received a decision in accordance with the Dublin Regulation that their application for asylum must be examined in another EU country (a so-called decision on transfer) have previously been entitled to assistance in accordance with the LMA until they leave Sweden. After 1 August 2017, such a decision will, in some cases, mean that their right to assistance in accordance with the LMA will end. This means that adults who do not live together with children for whom they are guardians will lose their right to accommodation and daily allowance when the decision becomes valid (which is usually three weeks from when the asylum seeker has been informed of the decision). Children and families with children will still have right to assistance in accordance with the LMA until they leave Sweden.
Extending a permit on based on need for protection
People who have been granted a temporary residence permit on based on need for protection and who apply for an extension of the permit will not have right to assistance in accordance with the LMA if they apply for an extension before the temporary residence permit expires. People applying for an extension to the residence permit on time will, instead, still be entitled to social benefits such as introduction benefits, study grants or parental allowance. Those applying on time will also be entitled to work while waiting for a new decision.
