More people gain the right to family reunification and permanent residence permits

Now, if you have a status as a person in need of subsidiary protection, you have the same right to family reunification as a refugee. If you are stateless, you may also have an opportunity to obtain a permanent residence permit.

Previously, essentially only a person with refugee status could be reunited with his or her family in Sweden. After a decision in the Swedish Parliament, if you have a status as a person in need of subsidiary protection, you have the same right to family reunification as a refugee. This also applies to those who were previously granted a residence permit as a person in need of subsidiary protection, but who did not have the possibility of family reunification. A prerequisite in order for your family to be able to apply to move to you in Sweden is that you have a good chance of obtaining a permanent residence permit.

In order for your family to be able to be reunited with you, you must have a valid residence permit in Sweden. If your residence permit expires in 2019, it means that you must first apply for an extension of your residence permit and have it granted before your family members can receive a decision on a residence permit. Your family may, however, submit their application before you have received a decision in your extension application.

Maintenance requirement

Another condition is that you must be able to financially support yourself and your family members, and also have a home of an adequate size and standard for you to live in.

If you are a person in need of subsidiary protection and received a temporary residence permit no later than 19 July 2019, you may be exempt from the maintenance requirement if your family members apply for a resident permit no later than 19 October 2019. If you are a person in need of subsidiary protection and received a temporary residence permit after 19 July 2019, you may be exempt from the maintenance requirement if your family members apply within three months of your temporary residence permit being granted.

Permanent residence permit for the stateless

Another change in the law is that if you are a stateless person, under certain circumstances you can receive a permanent residence permit.
