Continued uncertainty in Ukraine

The uncertain situation in Ukraine means that the Temporary Protection Directive will be extended, but the Swedish Migration Agency’s Legal Department assesses that it remains impossible to issue decisions in asylum applications.

The Temporary Protection Directive will likely be extended in the spring of 2023. This means that everyone covered by the Temporary Protection Directive will be able to get an extended residence permit in Sweden. You will receive information on how to apply for an extension well in advance of 4 March.

It is not possible to change the basis for your permit

As long as the Temporary Protection Directive continues to apply, everyone covered by it will primarily be granted a permit on this basis. The Swedish Migration Agency has been receiving questions from people who are protected under the Temporary Protection Directive who want to apply for a work permit because they have found employment. However, as long as the Temporary Protection Directive continues to apply, it is not possible to change the basis for a residence permit.

Children born in Sweden

If a child is born in Sweden to a parent who has protection under the Temporary Protection Directive, the child will also be covered by the Temporary Protection Directive, even if the other parent has a residence permit based on other grounds. This means that parents cannot choose which type of residence permit they apply for their child. Contact your unit for reception if you have recently given birth to a child or are due to give birth soon.

Asylum decisions are suspended

All decisions on applications for asylum from people who have fled the war in Ukraine remain suspended. This means that people who do not meet the conditions of the Temporary Protection Directive, and who instead apply for asylum, cannot obtain a decision in their asylum applications. The suspension of decisions also applies to applications for a declaration of protection status.
