You should apply for an extension before your temporary residence permit ends, but no earlier than three months before.
What happens if I submit my application for an extension after my current residence permit has ended?
If you do not apply for an extension before your residence permit expires, you will not be allowed to work while you are awaiting a decision, and you will also risk losing certain benefits, such as establishment support, student grants or parental benefits.
How can I show that I am still in need of protection?
If you have the same grounds for protection as earlier, you should state this. The Swedish Migration Agency will look at your first application and make an assessment of your need for protection based on how the situation looks today.
If you have new reasons, mention them when you apply for an extension. If you have a new passport, identity card or other new documents, you must bring them with you when you apply for an extension.
How long does it take to receive a decision?
The Swedish Migration Agency cannot say how long the processing time will be. However, if you apply for an extension before your temporary residence permit expires, you have the right to stay in Sweden while you await a decision.
What should I bring with me when I visit the Swedish Migration Agency to apply for an extension?
If you have a passport or other identity document, you must bring it with you. If you have any new document that demonstrates your grounds for asylum, you should bring them with you.
I was granted asylum, but my family came through their connection to me. What should they do to be able to remain in Sweden?
You family must also come to the Swedish Migration Agency to apply for an extension of their residence permits. If your current permits expire at about the same time, you should come to the Swedish Migration Agency together to apply for an extension. All family members who have a temporary permit must come to the Swedish Migration Agency. Each family member must fill out the form Underlag för ansökan om förlängning av uppehållstillstånd (“Supporting documentation for application to extend residence permit”). Family members who have a residence permit through connection to you should also fill out the form Frågeformulär om förhållande (“Relationship questionnaire”).
The maintenance requirement is only applicable the first time that your family applies for permission to move to Sweden to live with you. If your family has already been granted residence permits through their connection to you, and are living with you in Sweden, there is no requirement for you to be able to support your family when they apply for an extension of their residence permits.
Your family members’ permits will be for just as long as yours. If you have your residence permit extended by two years because you are still in need of protection, then they are also able to have their residence permits extended by two years. If you receive a permanent residence permit as an employee/self-employed person, your family will also receive a permanent residence permit.
What is required to receive a permanent residence permit based on employment or self-employment?
To be able to receive a permanent residence permit as an employee or self-employed person, it is necessary that
you have a temporary residence permit according to the temporary law,
you are at least 25 years old, or can demonstrate that you have completed a high school education in Sweden or an equivalent foreign education level,
you have sufficiently high income to support yourself through employment or your own business (you can combine incomes from different jobs and/or businesses you own),
your wages, insurance coverage and additional terms of employment are no worse than the terms laid down by Swedish collective agreements, or than what is normal practice in your occupation or industry,
your employment is not subsidized with any form of government grant (as with e.g. an entry recruitment job),
your employment is long-term, i.e. you have permanent employment or an employment contract lasting at least two years,
your employer has reported your employment to the Swedish Tax Agency,
your employment began no later than the final day of your temporary residence permit (a promise of employment or a signed employment contract is not sufficient),
you have the necessary permits, and any necessary licenses or credentials for practicing your occupation (e.g. a medical license or a taxi driving license).
Do I have the right to family reunification if I receive a permanent residence permit as an employee/self-employed person?
Yes, if you receive a permanent residence permit, your family has the right to apply for a residence permit through connection to you. The first time your family applies for permission to immigrate and join you in Sweden, you may be subject to a maintenance requirement.
