Children born in Sweden to people with certain types of permits can now get a residence permit without leaving Sweden
Children born in Sweden who have thus never entered Sweden, and whose parent has a research permit, an EU Blue Card or an ICT permit, can now obtain a residence permit without having to leave Sweden.
When you apply for a work and residence permit for the first time, you must do so outside Sweden, which means that the residence permit must be ready before you enter Sweden. This also applies to accompanying family members.
The Migration Court of Appeal has now ruled that the main rule in Chapter 5, Section 18 of the Aliens Act, i.e. that you cannot be granted a residence permit after you have entered Sweden, does not apply to applications for permits for children who were born in Sweden and are still in the country – because the child has not entered Sweden.
The Swedish Migration Agency considers that this should also apply when examining applications for permits for children of persons with permits that are otherwise regulated in a special way in the Aliens Act.
